Information on how to take part in the promotion, the rules for taking part in the promotion and the prize form part of these terms and conditions of participation.
Entry into the promotion constitutes acceptance of these terms and conditions of participation. Entry takes place exclusively via Instagram.
CONDITIONS FOR PARTICIPATION
Only Polish residents aged 18 and over (Participants) may take part in the promotion.
Directors, officers and employees (and their immediate families) of the Promoter, its affiliates, distributors, printers, suppliers, service providers, venues and agencies who are directly involved in the running of this promotion are not eligible to participate in the promotion. Immediate family means: spouse, former spouse, actual spouse, child or stepchild (natural or adopted), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, half-brother, half-sister or first cousin.
PROMOTION PERIOD
The promotion starts on 12 December 2023 and ends on 26 December 2023 at midnight.
HOW TO TAKE PART
To participate in the promotion, Participants must, during the Promotion Period:
- Follow Blundstone Poland's IG page @blundstonepl and @mirador_.
- Comment on the competition post on Instagram.
- Participants can receive an additional entry by sharing the post on their Instagram Stories.
- Entries are limited to two (2) per person.
- Entries will be deemed accepted when they are received by the Organiser and not when they are sent.
- Applications received will be considered final by the Organiser.
- Incomplete, inaccurate, erroneous, ineligible or unintelligible entries will be deemed invalid.
- The organiser is not responsible for late, lost or misdirected entries.
- Incorrect contact details entered by the Participant will invalidate the entry.
- The costs associated with accessing Instagram are at the Participant's discretion and may vary depending on the internet service or telecommunications provider used.
- The use of any automatic entry software or any mechanical, electronic or other means that allows the Entrant to automatically enter multiple entries is prohibited and will invalidate all entries submitted by the Entrant.
- All eligible Entries received during the promotional period will be entered into the draw.
One winner will be selected at random on 27 December 2023 at 2pm.
- All eligible Entries will be selected at random.
- It is a game of chance and skill plays no role in determining the winners.
- The winner will be notified in writing via direct message to the winning account on Instagram within two (2) days of the draw and the name and location of each winner may be published on the Organiser's website https://www.blundstone.pl/ and via Instagram @blundstonepl.
- The details may remain on the Organiser's website for a period of no less than twenty-eight (28) days and on the account on Instagram indefinitely.
The organiser will take all reasonable steps to notify the winners of the results of the draw.
The decision of the Organiser is final and no correspondence will be entered into with him.

NAGRODY
1.The total maximum value of the promotional prize pool is up to AUD 500.00 (including GST).
2.The prize package consists of one (1) pair of 500 Blundstone shoes personalised by Tasmanian artist Lauren Cassar.
3.The winner must inform the Organiser in writing that they have accepted the prize and any other details required, including Blundstone shoe size and postal address, within 5 working days of the Organiser notifying them of the prize, otherwise the prize may be forfeited.
4.The prize is not transferable or exchangeable and cannot be paid in cash (unless otherwise stated). The prize must be received as offered and cannot be changed. The prize cannot be used or exchanged in conjunction with any other offer.
5.The organiser is not responsible for any tax consequences that may arise from prizes won. Independent financial advice should be sought. The organiser is not responsible for any changes to prize values. All prize values are recommended retail prices in Australian dollars including GST tax.
GENERAL
(1) Entrants who provide inaccurate, misleading or false information will not be eligible to participate in the Promotion and all entries by an Entrant who is deemed by the Organiser to have provided inaccurate, misleading or false information may, at the Organiser's discretion, be deemed invalid.
(2) The Organiser reserves the right to require the Entrant to produce (within the required timeframe) the relevant photo ID or other documentation (at the Organiser's discretion) to confirm the Entrant's identity, age, home address, eligibility to participate in the promotion and claim the prize and any information provided by the Entrant as part of the promotion, prior to the release of the prize.
(3) If any documentation required by the Promoter (or the Promoter's nominated representative) is not received by the Promoter, or if an Entrant or Entry is not reviewed or approved to the satisfaction of the Promoter (or the Promoter's nominated representative), all entries of such Entrant may be deemed ineligible and invalid.
(4) The Organiser reserves the right to verify the validity of all Entries and to disqualify an Entrant for: (a) tampering with the entry process; (b) submitting an entry that does not comply with these Entry Terms; or (c) engaging in any unlawful or otherwise improper conduct calculated to compromise the fair and orderly conduct of the Promotion. The Promoter's rights to recover damages or other compensation from such offender are reserved.
5 The prize will only be awarded following verification of the winner, which the Promoter requires at its sole discretion.
(6) Any attempt to cause malicious damage or interfere with the lawful operation of this Promotion may constitute a breach of criminal and civil law, and if such an attempt is made, whether successful or not, the Organiser reserves the right to seek damages to the fullest extent permitted by law. If the Organiser suffers loss or expense as a result of a Participant's breach of these Terms of Participation or other legal obligations, the Participant agrees to compensate the Organiser for such loss, damage and expense.
(7) The decision to accept or reject an Entry rests solely with the Promoter and no correspondence will be entered into with the Promoter. Any Entry that contains content that the Promoter, in its sole discretion, deems to be offensive, obscene, crude or inappropriate in any way or that the Promoter deems may violate any law or other right of any person, corporation or entity will not be accepted as an eligible Entry for promotion. This includes, but is not limited to, any Entry that the Promoter deems to disparage any of its products and/or services or any of its prize providers or otherwise not in keeping with the spirit of the Promotion.
8. By taking part in the Promotion, Entrants acknowledge and agree that their Entry and their name and/or location may be displayed on the Promoter's social media platforms https://www.blundstone.pl/ or in the Promoter's audiovisual or printed materials for public viewing during the Promotion Period and in perpetuity. Once the Entry has been submitted, Entrants acknowledge that the Entry may not be withdrawn, amended or removed (except as required by the Promoter).
9. As a condition of participating in the Promotion, the Entrant agrees that the Organiser may, in the event of winning, use the Entrant's name, likeness, image and/or voice (including photograph, video and/or recording) in any media worldwide for an unlimited period of time without additional notice, remuneration or compensation for the purpose of promoting, advertising or marketing the Promotion (including its results) and/or promoting any products or services produced, distributed and/or supplied by the Organiser.
EXEMPTION FROM LIABILITY
(1) To the extent permitted by law, each Entrant indemnifies the Promoter and its employees, associates, agents and contractors against any and all Losses arising from:
breach by the Participant of any of these Conditions of Participation;
any third party claims arising directly or indirectly from the Participant's breach of any of these Terms and Conditions of Participation; the Participant's negligent, wilful or otherwise wrongful act or omission; the Participant's fraudulent or dishonest acts or omissions; any breach by the Participant of any applicable law; any claim by any third party (including individuals, legal entities and government departments or agencies) arising directly or indirectly from Participant's participation in the Promotion; death or injury to any person or any damage, loss or destruction of any real or tangible personal property to the extent caused by any act or omission of Participant; any claim or allegation that Participant's Entry infringes the intellectual property of a third party.
(2) In the event that a prize or prize element becomes unavailable for reasons beyond the Promoter's control, a comparable prize or prize element of equal or greater value will be awarded.
(3) If a prize or prize element becomes unavailable for any reason beyond the Organiser's reasonable control, a comparable prize or prize element of equal or greater value will be awarded in its place, subject to any written directions issued under the relevant legislation.
4 The promoter and its associated agencies and companies exclude all liability (including negligence), except for liability which cannot be excluded by law (including any applicable consumer warranty under consumer protection legislation), for any direct or indirect injury, loss and/or damage arising in any way from the promotion. This includes, but is not limited to: technical faults, delays or failures, including as a result of access to any material in relation to this promotion and any incorrect, inaccurate or incomplete information provided during or in relation to this promotion as a result of any technical faults, delays or failures; theft, unauthorised access or interference by third parties; lost or damaged entries, prize claims or prizes; and/or acceptance and/or use of any prize.
5.All decisions of the Organiser in relation to the promotion are final and no correspondence will be entered into with them.The Organiser is not responsible for the size or wear of the shoes once they have been received by the winner. It is the Entrant's responsibility to provide the Organiser with the correct size information.
PRIVACY
(1) The Organiser collects the Participant's Personal Data for the purposes of including the Participant in the promotion, awarding prizes (where applicable) and using the information to improve the Organiser's goods and services.If the required Personal Data is not provided, the Participant will not be eligible to participate in the promotion and will be deemed ineligible.
(2) The Entrant also agrees that the Promoter may, if the Entrant becomes a winner, publish or cause to be published the name and place of residence of the winner in any media as required by applicable law.
(3) If required to do so by law, the Organiser will provide each Winner, at the time of the award of the prize (or as soon as reasonably practicable thereafter), with a data collection statement detailing the Personal Data collected, the purpose of the collection, where the Personal Data is stored and how it is shared with third parties.
4. The data collection statement will comply with the Promoter's disclosure obligations or other obligations under relevant privacy legislation.
5. All Personal Data will be held by the Organiser in accordance with its Privacy Policy. By entering the Promotion, Participants acknowledge that another primary purpose of the Organiser's collection of Participant Personal Data is to contact the Participant in the future to provide information about the Organiser, including special offers, market research or to provide marketing materials to the Participant through any medium, including mail, telephone and commercial email or any other form of electronic, emerging, digital or conventional communication channel now or in the future.
IN THESE CONDITIONS OF PARTICIPATION:

"Intellectual Property Rights" means all present and future rights of any kind anywhere in the world, including, but not limited to, rights in respect of or in connection with copyrights, inventions (including patents), trademarks, service marks, trade names, domain names, designs confidential information, trade secrets and know-how and similar industrial, commercial and intellectual property rights, whether or not they are registered or subject to registration, and include the right to apply for registration of such rights, whether they exist in Poland or otherwise.
